INDIGICOMP TERMS OF USE

Welcome to IndigiComp, a proprietary compensation benchmarking tool provided by First Nations Human Resources Inc. (FNHR). By accessing or using IndigiComp, you agree to abide by these Terms of Use. If you do not agree to these terms, you must discontinue use immediately.
1. ACCEPTANCE OF TERMS
By accessing or using IndigiComp, you acknowledge that you have read, understood, and agreed to be bound by these Terms of Use and any applicable Canadian laws or regulations governing its use.
2. ELIGIBILITY
IndigiComp is available exclusively to individuals and organizations authorized by FNHR. Users must be at least 18 years old and have the legal authority to enter into this agreement on behalf of their organization.
3. PERMITTED USE
Users are granted a limited, non-exclusive, non-transferable license to access IndigiComp for internal business use only. This includes:
- Conducting compensation benchmarking and salary research.
- Utilizing data insights for workforce planning and decision-making.
Any other use, including but not limited to redistribution, modification, sublicensing, or commercial exploitation of IndigiComp’s data, is strictly prohibited without prior written consent from FNHR.
4. PROHIBITED USE
Users shall not:
- Share login credentials or grant unauthorized individuals access to IndigiComp.
- Scrape, extract, or automate data collection from the platform.
- Use IndigiComp for unlawful, fraudulent, or unauthorized purposes.
- Disclose, publish, or distribute confidential information obtained through IndigiComp to third parties.
- Reverse engineer, modify, or attempt to duplicate any part of IndigiComp.
5. INTELLECTUAL PROPERTY RIGHTS
All content within IndigiComp, including but not limited to data, software, text, graphics, and trademarks, is the exclusive property of FNHR and is protected by Canadian intellectual property laws. No rights are granted beyond the limited license specified in these Terms.
6. CONFIDENTIALITY
Users acknowledge that IndigiComp contains proprietary and confidential information. Users agree to maintain the confidentiality of this information and shall not disclose it to unauthorized parties. Any breach of confidentiality may result in legal action under Canadian privacy and intellectual property laws.
7. DATA ACCURACY AND DISCLAIMER
FNHR makes reasonable efforts to ensure the accuracy of the data within IndigiComp. However, we do not warrant that the data is error-free, complete, or up to date. Users should exercise discretion and conduct independent verification before making business decisions based on the information provided.
IndigiComp is provided “as is” without warranties of any kind, whether express or implied. FNHR disclaims all warranties, including but not limited to accuracy, reliability, and suitability for a particular purpose.
8. LIMITATION OF LIABILITY
To the fullest extent permitted by Canadian law, FNHR shall not be liable for any direct, indirect, incidental, consequential, or special damages arising out of or in connection with the use or inability to use IndigiComp.
9. MODIFICATIONS TO TERMS
FNHR reserves the right to modify these Terms of Use at any time. Updates will be posted within IndigiComp, and continued use of the tool after such modifications constitutes acceptance of the revised terms.
10. TERMINATION OF ACCESS
FNHR reserves the right to terminate or suspend access to IndigiComp at its discretion, including for violations of these Terms of Use or suspected unauthorized use.
11. GOVERNING LAW & DISPUTE RESOLUTION
These Terms of Use shall be governed by and construed in accordance with the laws of Canada and the province in which the user is located. Any disputes arising from these Terms shall be resolved through arbitration or mediation in accordance with Canadian legal standards.
12. COMPLIANCE WITH CANADIAN PRIVACY LAWS
FNHR is committed to complying with Canadian privacy legislation, including the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial laws. Users acknowledge that their data may be collected, stored, and processed in accordance with these regulations.
